Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB), has strongly opposed the continuation of his trial under Justice Binta Nyako at the Federal High Court in Abuja. His legal team, led by Special Counsel Aloy Ejimakor, argues that Justice Nyako had previously stepped down from the case on September 24, 2024, after Kanu expressed a lack of confidence in her ability to remain impartial. This recusal, according to Kanu’s lawyers, was made official and remains in effect, as no competent court has overturned it.
Despite this, the Federal Government, represented by its legal counsel, Adegboyega Awomolo (SAN), formally requested that the trial resume before Justice Nyako. However, Ejimakor, in a letter dated December 9, 2024, and addressed to the Deputy Chief Registrar of the Federal High Court, rejected this move. He stressed that proceeding with the case under Justice Nyako would be a serious legal misstep and could lead the court into making unconstitutional decisions.
Kanu has also voiced concerns regarding possible bias in his trial, asserting that Justice Nyako’s insistence on handling his case is influenced by corruption-related allegations involving members of her family. According to Kanu, there is an underlying scheme to secure his conviction in return for a favorable resolution regarding corruption cases involving Justice Nyako’s husband and son.
