The Federal High Court, Abuja, will on Friday, pass judgment in a suit filed by the Peoples Democratic Party against Governor Ben Ayade of Cross River.
The PDP, through its advice Emmanuel Ukala, SAN, has filed a lawsuit marked: FHC / ABJ / CS / 975/2021 before the Taiwo Taiwo justice to seek orders to fire the governors and their deputies to all Progressive Congresses, among others.
NewsGlobal on Tuesday, gathered from court 7, where Judge Taiwo presided over that an assessment of the number of lawsuits FHC/ABJ/CS/975/2021 filed by PDP against Governor Cross River and his deputies will appear on Friday, March 25.
Nan reported that Taiwo had, on Monday, ordered two lawmakers representing Cross River and 18 lawmakers from the State Assembly house to vacate their seats over their defection to the APC.
The judge gave the order following the marked suit: FHC / ABJ / CS / 971/2021 filed on 27 August 2021, by the PDP to challenge the defection of 20 MPs to the APC, with the Governor on 20 May 2021. Judge Taiwo, in his judgment, rejected the defense’s argument that the PDP (Plaintiff) did not have the local position (legal rights) to institute the case. He also rejected other preliminary objections raised by the dismissed MPs.
Taiwo ruled that the MPs’ argument that there was a grudge against the PDP that necessitated their defection against the APC was a take to mislead the court. The judge, who granted all the relief sought by the PDP, held that he was disappointing that the country’s politicians treated citizens as if they didn’t matter once they entered office. “A day will surely come when elected officials, have to resign from their offices or ask the people who voted for them before defecting to other political parties, instead of defecting to other parties without legal and citizen assistance,” he said.
According to him, we cannot continue sinning and expect abundant grace. The two affected members of the House of Representatives from the country are Michael Etaba and Legor Idagbor. 18 state parliamentarians including speaker, House of Assembly, Eteng Williams; Mich Etaba, Legor Idaagbor, Joseph Bassey, Odey Agbe and Okon Ephraim. Others are Regina Anyogo, Matthew Olory, Ekpo Bassey, Ogbor Udop, Ekpe Okon, Hillary Bisong, Francis Asuquo, Elvert Ayambem, Davis Etta, Minggu Achunekan, Cynthia Nkasi, Edward Ajang, Chris Ogar and Maria Akwaji.
While Mr Etaba represents the Obubra/Etung Federal constituency, Idagbor represents the Obudu/Obalaku/Bekwarra Federal constituency.
