Mazi Nnamdi Kanu
The Court of Appeal in Abuja has set free the embattled leader of the Indigenous People of Biafra, Nnamdi Kanu.
Kanu is being prosecuted by the Federal Government in the Federal High Court Abuja on 15 bordering charges, including treason and terrorism offences he allegedly committed in the course of his separatist campaigns.
A three-man panel of the Appeal Court said the Federal High Court lacks jurisdiction to try him in view of his abduction and extraordinary rendition to Nigeria in flagrant violation of the OAU’s extradition convention and protocol.
The court held that the 15-count charge brought against Kanu did not disclose the place, date, time and nature of the alleged crimes before he was illegally extradited to Nigeria in clear violation of international treaties.
The court further held that the federal government did not disclose where Nnamdi Kanu was arrested despite the serious allegations against him.
Barr. Ifeanyi Ejiofor
Barr. Ifeanyi Ejiofor, one of Kanu’s lawyers, confirmed the development on Thursday evening.
The court ruled that the “extraordinary rendition” of Kanu from Kenya was illegal and therefore constitutes an impediment to further trial.
